Welcome to NexifyWP. These Terms of Service govern your use of our WordPress management platform. By creating an account and using NexifyWP, you agree to be bound by these terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using NexifyWP (the "Service"), you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with all terms outlined here.
If you are using NexifyWP on behalf of a business or agency, you represent that you have the authority to bind that organization to these terms.
2. Use of the Service
Permitted Use
NexifyWP grants you a limited, non-exclusive, non-transferable license to use the Service for managing WordPress websites for yourself or your clients, in accordance with these terms.
Prohibited Use
- You must not use NexifyWP for any illegal, unauthorized, or fraudulent purpose.
- You must not attempt to reverse engineer, decompile, or extract the source code of any NexifyWP software.
- You must not use the Service to distribute malware, spam, or any form of malicious code.
- You must not attempt to gain unauthorized access to other users' accounts or data.
- You are fully responsible for all activity that occurs under your account.
3. Service Provisions & Limitations
Backups
NexifyWP maintains up to 3 most recent automated backups per connected site. While we make every reasonable effort to ensure backup integrity, you are ultimately responsible for maintaining your own off-site backup strategy for critical data.
NexifyWP backups are a convenience feature, not a replacement for a comprehensive disaster recovery plan.
Uptime Monitoring
Our uptime monitoring service provides real-time alerting for website downtime. While we strive for accurate and timely detection, NexifyWP is not liable for losses incurred during periods of website downtime, nor for any delays in alert delivery caused by email provider issues or other factors outside our control.
Security
You are responsible for keeping your NexifyWP account credentials and all API keys secure.
If you suspect unauthorized access to your account, notify us immediately at support@nexifywp.com .
NexifyWP will never ask for your WordPress admin password via email or any communication outside the platform.
Service Availability
We work hard to keep NexifyWP available and reliable. However, we do not guarantee 100% uptime and may perform scheduled maintenance with or without prior notice.
We will make reasonable efforts to inform users of planned downtime in advance.
4. Account Termination
You may terminate your NexifyWP account at any time. Upon termination, your access to the dashboard ceases, but your connected WordPress sites remain unaffected and continue to function normally.
NexifyWP reserves the right to suspend or terminate accounts for violations of these Terms of Service, abusive behavior, or activities that may harm other users or the platform.
5. Intellectual Property
All NexifyWP branding, software, and platform content are the intellectual property of NexifyWP and its creators.
You may not reproduce, distribute, or create derivative works without explicit written permission.
6. Limitation of Liability
To the maximum extent permitted by applicable law, NexifyWP and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service — including but not limited to loss of data, revenue, or business opportunities.
7. Governing Law
These Terms of Service are governed by applicable law. Any disputes arising from use of the Service shall be resolved through good-faith negotiation in the first instance.
Legal proceedings, where necessary, shall be subject to the jurisdiction in which NexifyWP operates.
8. Changes to These Terms
We may update these terms from time to time. When we make significant changes, we will notify you via email.
Continued use of NexifyWP after changes take effect constitutes your acceptance of the revised terms.
